1. Agreement
These Terms of Service (“Terms”) govern your access to and use of cardclaw.io and the CardClaw web application (the “Service”), operated by CardClaw. By using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or 16 if you are in the EEA) to use the Service. By using CardClaw you represent that you are of legal age in your jurisdiction.
3. Accounts
You may use most of the Service without an account. When you create an account, you are responsible for keeping your sign-in credentials secure and for all activity under your account. Notify us immediately of any unauthorized use.
4. The Service
CardClaw provides trading-card market intelligence: a camera scanner that identifies printed cards, price data sourced from public marketplaces, and tooling to help sellers prepare bulk eBay listings. Prices are best-effort references — not appraisals or financial advice.
5. Acceptable Use
You agree not to:
- Use the Service to violate any law or third-party right.
- Attempt to reverse-engineer, scrape at scale, or disrupt the Service.
- Upload images you do not have rights to, or images depicting people without their consent.
- Submit content that is defamatory, infringing, or otherwise harmful.
6. Your Content
You retain ownership of images and other content you upload. By uploading, you grant CardClaw a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, re-encode, and display that content for the purpose of operating the Service. You also grant us a license to use de-identified versions of those images to improve the platform’s identification accuracy. You may delete your content at any time, after which we will purge it from active systems within 30 days.
7. Third-Party Marketplaces
CardClaw helps you prepare CSV files for upload to eBay’s File Exchange and Seller Hub. We are not affiliated with eBay. Your relationship with eBay (and any other marketplace) is solely between you and that marketplace, governed by its own terms.
8. Trademarks & Trading-Card IP
Trading-card names, set names, art, and trademarks are the property of their respective rights-holders. CardClaw is independent: not affiliated with, endorsed by, or sponsored by The Pokémon Company International, Nintendo, Game Freak, Creatures Inc., or any publisher. Card images are sourced from publicly available APIs and used under nominative fair use for price reference. 9. Subscriptions and Payments
The Service is currently free during public beta. Future paid tiers will be billed through Lemon Squeezy as Merchant of Record, subject to its terms and any applicable sales tax / VAT. We will give at least 14 days’ notice before any free feature becomes paid.
10. Termination
You can stop using CardClaw at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to other users or to us. We will give reasonable notice when feasible.
11. Disclaimers
The Service is provided “as is” and “as available.” CardClaw does not warrant that prices are accurate, complete, or current; that the scanner will identify every card; or that the Service will be uninterrupted or error-free. To the fullest extent allowed by law, CardClaw disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent allowed by law, CardClaw and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill arising out of or in connection with your use of the Service. CardClaw’s total liability for any claim arising out of or relating to these Terms is limited to the greater of (a) US$50, or (b) the total amount you paid to CardClaw in the 12 months preceding the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless CardClaw and its operators from any third-party claim arising out of your use of the Service, your content, or your violation of these Terms.
14. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law principles. The courts of Allegheny County, Pennsylvania, have exclusive jurisdiction over any dispute, except where applicable law gives you the right to bring claims in your local courts.
15. Changes
We may update these Terms. We’ll post the new effective date at the top and, for material changes, notify registered users by email at least 14 days before the change takes effect.
